By accessing or using NicheValidator ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, don't use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

NicheValidator is a SaaS platform that helps entrepreneurs:

• Discover business opportunities by analyzing pain points from Reddit
• Validate market demand using Google Trends data
• Match opportunities to proven business models
• Follow step-by-step workflows from idea to first dollar
• Track revenue and celebrate milestones

We provide the tools and data, but your success depends on your execution. We make no guarantees about income or results.

3. Account Registration

Eligibility

• You must be at least 18 years old
• You must provide accurate and complete information
• You must maintain the security of your account
• One account per person (no multiple free accounts to bypass limits)

Account Security

• You're responsible for all activity under your account
• Use a strong, unique password
• Notify us immediately of any unauthorized access
• We're not liable for losses from unauthorized access if you didn't notify us

4. Subscription & Payment

Plans & Pricing

• Free Plan: Limited features (3 niches, 1 poll/month)
• Beta Plan: $19.99/month, all features, locked-in pricing forever (limited to 100 users)
• Premium Plan: $29/month, all features

Billing

• Subscriptions are billed monthly on the date you subscribed
• All plans include a 7-day free trial
• Payment is processed securely via Stripe
• You authorize us to charge your payment method automatically
• Prices are in USD unless otherwise stated

Price Changes

• We may change prices with 30 days' notice
• Exception: Beta users' pricing is locked in forever ($19.99/mo)
• Continued use after price changes constitutes acceptance

5. Cancellation & Refunds

• Cancel anytime from your dashboard or by contacting support
• Cancellation takes effect at the end of your current billing period
• No refunds for partial months (except 30-day money-back guarantee)
• 30-Day Money-Back Guarantee: Full refund if you cancel within 30 days of first payment

6. Acceptable Use

You May:

• ✅ Use the Service for legitimate business research
• ✅ Share opportunities with your team or audience
• ✅ Create content about opportunities you find
• ✅ Export your own data

You May NOT:

• ❌ Scrape, copy, or resell our data
• ❌ Reverse engineer or decompile the Service
• ❌ Create multiple accounts to bypass limits
• ❌ Use the Service for illegal activities
• ❌ Abuse Reddit or other third-party platforms we integrate with
• ❌ Overload our servers with automated requests
• ❌ Share your account credentials

7. Intellectual Property

Our IP

• NicheValidator owns all rights to the platform, code, design, and branding
• You get a limited license to use the Service while subscribed
• This license terminates when your subscription ends

Your Content

• You own the content you create (polls, saved opportunities, etc.)
• You grant us permission to store and display your content
• If you share a success story publicly, we may feature it (with your permission)

8. Affiliate Program

• Affiliates earn 30% recurring commission on referrals
• Referral cookies last 30 days
• Minimum payout is $50
• Payouts are processed monthly via PayPal
• We may terminate affiliate accounts for fraud or TOS violations
• Affiliates must comply with FTC disclosure guidelines

9. Beta Program

• Beta program is limited to 100 founding members
• Beta pricing ($19.99/mo) is locked in forever
• Bug bounty rewards: Critical = 3 months free, Major = 1 month free
• Beta users get priority support (4-hour response time)
• We reserve the right to close beta at any time

10. Disclaimers & Limitations

No Income Guarantees

We provide tools and data, but we cannot guarantee you will make money. Your results depend on your effort, execution, market conditions, and many other factors. Any success stories or testimonials are not typical results.

Third-Party Data

We aggregate data from Reddit, Google Trends, and other sources. We don't control these sources and cannot guarantee accuracy, completeness, or availability.

Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted access. We're not liable for downtime, maintenance, or service disruptions.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• NicheValidator is provided "AS IS" without warranties
• We're not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the last 12 months
• We're not responsible for lost profits, data, or business opportunities

11. Changes to Service

• We may add, modify, or remove features at any time
• We'll notify you of major changes via email or in-app notice
• Continued use after changes constitutes acceptance
• We may discontinue the Service with 90 days' notice

12. Termination

You Can:

• Cancel your subscription anytime
• Delete your account from settings
• Export your data before deleting

We Can:

• Suspend or terminate accounts for TOS violations
• Terminate accounts for non-payment
• Terminate for fraudulent activity
• We'll try to notify you first unless it's an emergency

13. Dispute Resolution

• Contact Us First: Most issues can be resolved through support
• Governing Law: These Terms are governed by [Your State/Country] law
• Arbitration: Disputes will be resolved through binding arbitration, not court
• Class Action Waiver: No class actions; disputes must be individual

14. General

• Entire Agreement: These Terms constitute the entire agreement
• Severability: If any provision is invalid, the rest remains in effect
• No Waiver: Our failure to enforce a right doesn't waive that right
• Assignment: You can't transfer your account; we can assign these Terms
